{"id":7067,"date":"2017-11-06T08:45:25","date_gmt":"2017-11-06T16:45:25","guid":{"rendered":"https:\/\/www.sands-trustee.com\/?p=7067"},"modified":"2020-01-02T13:40:19","modified_gmt":"2020-01-02T21:40:19","slug":"bankruptcy-canada-four-common-myths-debunked","status":"publish","type":"post","link":"https:\/\/www.sands-trustee.com\/blog\/bankruptcy-canada-four-common-myths-debunked\/","title":{"rendered":"Bankruptcy in Canada: Four Common Myths Debunked"},"content":{"rendered":"<p>Even though there are many resources and much information available, myths and outright incorrect information about bankruptcy in Canada continue to circulate.\u00a0 As Licensed Insolvency Trustees, Sands &amp; Associates is comprised of professionals empowered by the Federal Government to provide debt solutions, including personal bankruptcy, and we\u2019ve put together our \u2018Top Four Common Bankruptcy Myths\u2019 to help separate the fact from fiction:<\/p>\n<h2><strong>Myth: Declaring bankruptcy in Canada lasts for seven years (or longer) <\/strong><\/h2>\n<p><strong>Fact: <\/strong>The vast majority of personal bankruptcies (~80%) last only nine months, and cost around $200 per month for the nine-month bankruptcy term (these are the minimum fees set by the Federal Government).\u00a0 Most individuals starting bankruptcy proceedings are eligible for an automatic discharge (release from bankruptcy) after nine months.<\/p>\n<h2><strong>Myth:\u00a0 Filing bankruptcy is permanently on your credit history<\/strong><\/h2>\n<p><strong>Fact:\u00a0 <\/strong>A first-time bankruptcy will be reflected on a credit history report for six years following the person\u2019s discharge (exit) from bankruptcy.\u00a0 The notion that either bankruptcy, credit counselling or a Consumer Proposal prevents a person from obtaining future credit forever is completely false.\u00a0 Oftentimes credit is re-established within two to three years following a bankruptcy, and resources to rebuild credit are provided as part of the bankruptcy services.<\/p>\n<h2><strong>Myth:\u00a0 Bankruptcy can\u2019t eliminate income tax debt<\/strong><\/h2>\n<p><strong>Fact:\u00a0 <\/strong>Filing a bankruptcy or a Consumer Proposal are in fact the only methods available to eliminate or reduce government debts and the accompanying interest and penalties.\u00a0 Income taxes, GST, student loans, MSP and even ICBC debts can all be dealt with via a Licensed Insolvency Trustee.<\/p>\n<h2><strong>Myth:\u00a0 All assets must be surrendered in a personal bankruptcy<\/strong><\/h2>\n<p><strong>Fact:\u00a0 <\/strong>Contrary to conventional wisdom which says that you lose everything if you go bankrupt, most people keep all of their assets when filing bankruptcy in Canada.\u00a0 BC legislation sets out a base level of assets that are considered \u201cexempt\u201d (meaning you do not have to surrender them if you start bankruptcy).\u00a0 Provincial exemption allowances are in place for many assets, including: RRSPs, home equity, household goods, a vehicle, and tools of the trade.<\/p>\n<p>Debt management solutions often feel overwhelming, and navigating the available information can seem like a daunting task.\u00a0 If you\u2019re considering personal bankruptcy as a debt solution, <a href=\"https:\/\/www.sands-trustee.com\/free-debt-consultation\/\">contact a Licensed Insolvency Trustee<\/a> to discuss your situation and all your options.\u00a0 They will meet with you at no cost or obligation, and no referral is required.\u00a0 Find out the facts!<\/p>\n<p><strong><em><a class=\"first-child last-child\" href=\"https:\/\/www.sands-trustee.com\/free-debt-consultation\/\">Meet with a representative<\/a> in one of our BC locations, and find out how we can help you become debt-free during a <a href=\"https:\/\/www.sands-trustee.com\/free-debt-consultation\/\">confidential debt consultation<\/a>.
